Court Clarifies Mandhira Kapur Has No Role in Ongoing Proceedings

In a fresh twist to the inheritance battle over late Sona Comstar chairman Sunjay Kapur’s will, the Delhi High Court on Friday removed his sister, Mandhira Kapur, from the case. The court clarified that she is not a party to the ongoing proceedings and rectified earlier records that had wrongly included her name.

The order came in response to a plea filed by Priya Kapur, Sunjay Kapur’s widow and third wife, who alleged that Mandhira had attempted a “backdoor entry” into the matter. Priya argued that Mandhira had never filed an application to be impleaded and that her inclusion appeared to be a deliberate move to gain an advantage in the estate dispute.

Widow Raises Objection

Priya Kapur’s plea highlighted that the lead counsel supposedly representing Mandhira Kapur had not appeared in court or made any submissions, even when the Bench had asked all lawyers to present themselves.

Justice Jyoti Singh, who presided over the matter, acknowledged that the 10 September order had mistakenly recorded the counsels’ appearance on behalf of Mandhira Kapur. The court has now rectified the records, confirming that she holds no standing in the case.

The Larger Dispute

The estate battle gained momentum after Samaira and Kiaan, Sunjay Kapur’s children from his second marriage with actor Karisma Kapoor, approached the High Court. They challenged a will that allegedly leaves Sunjay’s entire personal estate to Priya Kapur, excluding them.

The children argued that they were denied access to a copy of the will despite repeated requests. They are seeking one-fifth share each of their late father’s personal assets.

According to court documents, the will surfaced during a 30 July meeting at Taj Mansingh Hotel in Delhi, attended by Priya Kapur, her legal team, Shradha Suri Marwah (executor of the will), and directors of Aureus Investment Pvt. Ltd., the promoter of Sona Comstar. However, questions remain on whether the will was formally registered.

Next Hearing in October

The court has directed disclosure of Sunjay Kapur’s assets and asked all parties to submit their responses within two weeks. The matter is now scheduled for hearing on 9 October.

The petition currently names Priya Kapur, her son Azarius Kapur, Sunjay’s mother Rani Kapur, and executor Shradha Suri Marwah as defendants. Two directors of Aureus Investment, Dinesh Agarwal and Nitin Sharma, have also been accused of colluding with Priya to transfer assets in her favor.

As the high-profile dispute unfolds, the removal of Mandhira Kapur marks a significant clarification, narrowing the focus of the case to the immediate claimants and executors of Sunjay Kapur’s will.
