Karisma Kapoor–Sunjay Kapur Divorce Records: The Supreme Court is set to examine a sensitive legal plea involving confidential divorce records of actor Karisma Kapoor and late industrialist Sunjay Kapur, as an inheritance dispute continues to unfold following Kapur’s death. The case has drawn attention not only because of the high-profile individuals involved but also due to the larger legal questions it raises around privacy and access to sealed judicial documents.
Priya Kapur, the former wife of Sunjay Kapur, has moved the Supreme Court seeking certified copies of documents related to the couple’s 2016 divorce proceedings. In her plea, she has requested access to confidential records, including details of the financial settlement and child custody arrangements agreed upon between Karisma Kapoor and Sunjay Kapur. These documents were part of an in-camera hearing and were accessible only to the former couple at the time.
The matter is scheduled to be heard on Tuesday before a bench headed by Justice A.S. Chandurkar. At the heart of the case lies the question of whether confidential divorce records can be shared with a third party who was not involved in the original proceedings. The court’s decision is expected to have wider implications for privacy rights in matrimonial disputes.
The request for access to the divorce records has gained significance after Sunjay Kapur’s death in July last year, which led to a legal battle over his estate. Priya Kapur has argued that examining the divorce settlement is essential to understand the financial obligations undertaken by Sunjay Kapur, which could have a bearing on the inheritance claims now under dispute.
Karisma Kapoor and Sunjay Kapur were granted a mutual consent divorce in 2016. As per the settlement, custody of their two children, Samaira and Kiaan Kapur, was awarded to Karisma Kapoor, while Sunjay Kapur was given visitation rights. The financial and custodial terms were recorded during a closed-door court proceeding, and the documents were not made part of the public record.
Sources indicate that Karisma Kapoor’s children have now approached the Supreme Court seeking criminal action against Priya Kapur. They have also raised objections over alleged inconsistencies in the digital trail of a will that Priya Kapur presented before the Delhi High Court. The children have expressed concerns about the privacy of sealed court records and the possible misuse of confidential information.
The application seeking access to the divorce documents was filed in late November, just days before the Delhi High Court reserved its order on an injunction related to the inheritance dispute. Legal observers note that the timing of the plea has added urgency to the matter, as parallel proceedings continue in different courts.
